What are Some Benefits of Divorce Mediation?

Keep in mind, with mediation:

  1. You will see results sooner. Mediation provides a more timely way of resolving disputes. The family courts are jammed. It takes months to get a court date and it’s not uncommon to have trial days spread over a year’s time. Mediation only requires you to work your schedule with the mediator’s.
  2. You will preserve the ongoing relationship or termination of a relationship in a more amicable way. This is particularly important when you have children and will need to co-parent with the other parent for the years to come.
  3. You will be more satisfied with the outcome. Mediation allows you and the other party to reach mutually agreeable solutions, as opposed to a judge or other third party decision-maker.
  4. You will save money. Mediation is less expensive when contrasted to the expense of litigation or other forms of fighting.
  5. You are more likely to see follow through. Parties who have reached their own agreement in mediation are also generally more likely to follow through and comply with its terms than those whose resolution has been imposed by a third party decision-maker, like a judge.
  6. You will have a more comprehensive and customized agreement. Mediated settlements are able to address more than the legal issues. In family law, this is particularly important. Mediated agreements often cover procedural and psychological issues that a court could not decide.
  7. You will have more control and a more predictable outcome. You are not leaving this to a judge who doesn’t know you or your family to decide.  When you negotiate your own settlement, you have more control over the outcome.
  8. You can implement workable agreements. In mediation, you can specifically tailor procedures as to how your agreements will be carried out.
  9. You will feel empowered. People who negotiate their own settlements often feel more powerful than those who use surrogate advocates, such as lawyers, to represent them.
